Frequently Asked Questions
What rights do nursing home residents have in Texas?
Texas and federal law guarantee rights including dignity, privacy, freedom from abuse and neglect, participation in care planning, access to medical records, control of personal finances, and the right to file complaints without retaliation. See our Residents' Rights Guide for the full list.
How do I file a complaint about a nursing home in Texas?
You can file a complaint with the Texas Health and Human Services Commission (HHSC) by calling 1-800-458-9858 or submitting online. Complaints can be anonymous. You can also file a complaint with the Long-Term Care Ombudsman program, which advocates for residents at no cost.
Can a nursing home evict a resident in Texas?
Nursing homes can only discharge residents for specific reasons under federal law: the resident's needs cannot be met, the resident no longer needs nursing home care, the resident endangers others, or the resident has not paid. The facility must provide 30 days written notice and a safe discharge plan.
